Examining citizen participation: theory and practice

As a researcher of citizen participation I often discuss the functioning of local democracy with, among others, councillors, officers and citizens. These discussions are showing that knowledge of democratic theory in the field is not often very present.

Partly, this is understandable –if the field consisted of political scientists only, would democracy function at all? But it seems as if limited knowledge about democracy creates some practical problems. To put it more precisely, the perspective on democracy appears to depend on the slogan: ‘where you sit is where you stand’. Councillors see themselves as guardians of democracy, because they are (the only ones) elected, and are the representatives of the people. Officers don’t often understand the (seemingly) irrational decisions councillors make and see democracy often as frustrating for their policy process. Citizens are distant observers and only a few committed citizens are actually participating in democratic processes.

Councillors and officers have been aiming for (more) citizen participation since the 1990s. But what effect does citizen participation have on local democracy?

Citizen participation is vital to democracy

Citizen participation is usually seen as a vital aspect of democracy. Many theorists claim that citizen participation has positive effects on the quality of democracy. Theories of participatory democracy, deliberative democracy and social capital assert that citizen involvement has positive effects on democracy. It contributes to the inclusion of individual citizens in the policy process, it encourages civic skills and civic virtues, it leads to rational decisions based on public reasoning, and it increases the legitimacy of the process and outcome. These aspects are summarized in the table below.

What councillors and officers are telling me is that they are not fully aware of all these different aspects, but like the overview. It helps them to reflect on democracy from different angels.

Local participatory policymaking in the Netherlands

My article – co-authored by Ank Michels – examines the probability of these claims for local participatory policymaking projects in two municipalities in the Netherlands. However, I think that the claims can also be applied to local democracy in the UK and other countries. The article focuses on the relations between citizens and government from a citizens’ perspective.

The findings show that the role of citizens in participatory projects is limited, serving mainly to provide information on the basis of which the government can then make decisions. Nevertheless, the article argues that citizen involvement has a number of positive effects on local democracy: not only do people consequently feel more responsibility for public matters, it increases public engagement, encourages people to listen to a diversity of opinions, and contributes to a higher degree of legitimacy of decisions. One negative effect is that not all relevant groups and interests are represented. The article concludes that for a healthy democracy at the local level, aspects of democratic citizenship are more important than having a direct say in decision-making.

Reflecting on the functioning of (your local) democracy can be a fruitful exercise once in a while. The framework of analysis that was presented here may help, among others, councillors, officers and citizens to understand democracy more broadly and empathise with (each) other’s perspectives and roles.

Can Gov 2.0 transform Local Government?

Is there an appetite for more change in local government? In particular change that could challenge local council’s traditional relationships with the public, and how Councils conduct their business?

Drawing inspiration from the revolutionary changes enabled by the development of the collaborative web (web2.0) in the worlds of retail and peer to peer networking, a number of technologists and democrats have sought to harness the power of technology to make government better and democracy stronger by leveraging the power of citizens. Can Gov2.0 live up to the hype and deliver real transformation to local government in the UK; and will government open the door to these changes?

The Gov2.0 vision of an improved council is drawn from the underlying belief that more citizen choice and participation is a good thing, and that for this to happen citizens need access to information (open and transparent government). This vision runs contrary to James Madison’s view, which has dominated the structure of modern liberal democracy, that the election of representatives serves to refine and enhance the public debate. Rather it is argued that the representative system serves to undermine public understanding of the issues in favour of the party platform and sound bite politics. A lack of public information serves to obscure “true” organisational activity and behaviour, allowing waste to go unchallenged.

The harnessing of technology and of collaborative networks  makes access to large amounts of information, and open public debate possible; but also opens the door to another significant area of change, the use of publicly available information to develop and deliver services independently. Examples of this can be seen in the City of New York 311 apps competition, with applications based on public data delivering public services ranging from advice to urban poultry farmers to city emergency planning. These are not City services, rather community services facilitated by publication of public data. The development of community based services hosted and facilitated by local government shifts the Council to a position of being a platform provider, not just a service provider.

Making use of collaborative technology is not an untested idea in the arena of public policy. The use of social media in the reform of the Icelandic constitution in 2012 shows how people can engage and be part of a topic that would otherwise be restricted to the chosen few. More views and opinions produce better policies. Contrary to this, it may be argued that the public neither know enough, nor care enough about the day-to-day functioning of local government services, that they will not understand the technical details sufficiently to make decisions. Ignoring for now the patronising nature of these arguments that suggest that engagement in the process requires training and should therefore be restricted to a technocracy, the nature of mass involvement is that the question at hand is viewed from a diversity of perspectives, rather than just the limited perspective of the expert and elected representative.

The notion of a transformational change represents an appeal to a grand narrative of perfection. Transformation is an idea that is underscored by a belief that change will result in something which is “better” than before. This belief in a singular “better” future has driven the recent history of changes in the structure and organisation of local government. Rarely, however, do changes proposed seek to harness the citizen, rather than altering the organisational structure. That is perhaps the major difference between Gov2.0 and its predecessors such as New Public Management. Rather than being an appeal to the notion of singular perfection, Gov2.0 is an appeal via the citizen, to the bespoke – community government made by the public for the locality.

Gov2.0 is a set of ideas, which if implemented have the  power and the potential to transform the relationship between local government and those it serves, it can open up the development of policy and services to a wider audience, and allow the sunlight of transparency to shine in areas that have been hidden in the shadows. If the political will exists then Gov2.0 can make local government everybody’s business, not just the preserve of a chosen few.

Why do we need a new model of public services?

Public services, including those commissioned and delivered by local government, have changed substantially in the past ten years. There have been changes in service delivery mechanisms, in relationships between users and services, in organisational structures and in partnership arrangements. It appears likely that the next ten years will bring at least as much change, if not more. One thing is clear: the old model of public services – people expect and services provide – is no longer tenable.  The growing gap between demand and resources has been described in terms of ‘the jaws of doom’.  That is one way of looking at the future.  Another way is to see the opportunities which we have to renegotiate ‘the deal’ between people and public services.

INLOGOV is working with a wide range of local authorities and other bodies to test a new model of public services. The model draws together many of the themes in current debates about the ways in which the public sector is likely  to have to change, in particular, how public services can manage demand, build capacity and achieve better mutual understanding, through the development of stronger relationships with communities as well as through co-production and behaviour change.  The purpose of this model is to support public service leaders – both political and managerial – to make better sense of a complex world.

INLOGOV’s model brings together the disparate cultural, structural, political and financial challenges facing local government and wider public services into an integrated framework, which takes account not only of individual drivers of change but also of the inter-relationship between changes in public services and the wider political and social context in which those changes are taking place. If we have a coherent model which reflects current and future realities it will be easier for us to explore possible solutions together.

We have concentrated on the challenges and opportunities for local government, in partnership with other local and national institutions.  That is not because we think local government is the most important player on the public service stage, it is because we think it plays a unique role as a convenor and mediator between conflicting interests within complex networks of players.  It is in this role that it can provide the creativity and connectivity to help shape solutions to the seemingly intractable problems of rising demand and falling resources.

The key drivers for a new model are: building stronger relationships with and between individuals and communities, increasing co-production of better outcomes by focusing on capacity, as well as need, and changing expectations and behaviours.  Before we can deliver these benefits we will need to change the way we think, plan and act.  There are many good, small scale examples of innovation which are delivering real change but now we need to scale up change to have a real impact – reducing dependency, building confidence and improving outcomes.  These are not quick fixes, so the sooner we start and the more energy we invest the sooner we’ll be able to achieve a sustainable relationship between public services and the communities they serve.

What is the place of emotion in the making of policy?

In the years I spent shuttling between local initiatives in low income neighbourhoods and oddly clean cupboard rooms in Westminster, I never really cracked the way the experience of disadvantage was absorbed or dismissed as ‘personal’ and disconnected from policy.

You see this constantly in the skirmishes of local democracy of course – a local meeting where an officer or elected member gets a thorough bashing by a resident who’s living a kind of hell that current policies don’t address. Fierce steam gets released but policy is unaffected.

Such occasions can be off-putting for the well-meaning policy maker. I think most are aware of the gravitational effect here, caused often by internal pressures of work, of the risk of gradually becoming detached from local experience.

Politicians shield themselves from occasional bombardment, and disparage the ‘personal’ as ‘emotional’ while routinely exploiting examples through the media when it suits them to do so.

Sometimes politicians try to use public events to draw the sting of citizens’ anger, and occasionally find they’ve over-estimated their own political skills. When they view confrontation with residents as political sport and not as a chance to understand and address needs, that illustrates the tension I’m talking about.

At the same time, people who have profound experience of the failure of social systems to protect them, may not have the perspective that helps anyone relate it to policy in a meaningful way. But sometimes you hear a really considered, articulate exposition of experience that takes the personal and places it in a generalised policy context. That’s rare, and risks diluting the very emotion of lived experience that gives pertinent urgency to the cause. And often intermediaries, like housing workers say, who can speak the equivocal language of policy while combining understanding of several individual examples of disadvantage, can make contributions that are valued and welcomed by both sides.

So what is the place of emotion in the making of policy? Rosie Anderson has done some work on this ‘essential but difficult territory’ and TSRC have just published a fascinating paper based on policy making around poverty in Scotland (Summary; 4-page briefing; working paper). Emotional knowledge, she says, is frequently described by her informants as ‘ambiguous, unreliable and potentially overwhelming knowledge – in contrast with “rational” knowledge, which is the prerequisite for “professionalism” in policy-making and a necessity for making policy decisions.’ This sounds a lot like what Ivan Illich described as a ‘cognitive disorder’, resting on the illusion that

‘the knowledge of the individual citizen is of less value than the “knowledge” of science. The former is the opinion of individuals. It is merely subjective and is excluded from policies. The latter is “objective” – defined by science and promulgated by expert spokesmen. This objective knowledge is viewed as a commodity which can be refined… and fed into a process, now called “decision-making.” This new mythology of governance by the manipulation of knowledge-stock inevitably erodes reliance on government by people.” (Tools for conviviality, 1973).

Anderson makes the point that policy processes are contrived to exclude subjectivity and individuality. And if people are to engage with those processes, it’s hard to see what else they are to bring to them. I have been in public meetings where a roomful of people, having collectively an enormous wealth of knowledge about the local issues under discussion, have sat in disconnected silence because the language and process disenfranchised them at the very point they were supposed to be being ‘invited’ to participate. Even the most well-meaning policy makers can flounder at this point.

Conversely, there are those meetings which seem like unstructured and unruly free-for-alls, a sequence of barely related angry rants. As Anderson says,

‘In practice this process of moving from the particular and emotional to general and impersonal, so simple-sounding on paper, is actually very difficult to get right in the eyes of policy practitioners because of emotional knowledge’s ambiguous status in policy.’

Partly, I have no doubt, this is an educational issue. As I have said often before, too many of us emerge from the education system with no idea how local democracy functions. For a long time it’s been in the interests of politicians to keep things that way, although some of them appear to be less sure nowadays (that’s a network society effect, I think). And Anderson raises the question of how we provide better support for policy workers emotionally when they engage with such lived experience.

We’ve all talked about emotional intelligence over the years. But it strikes me as curious that no-one seems to have got to grips with this topic before. This is a hugely important site of conflict and potentially fruitful understanding, and Anderson has pin-pointed the significance of ‘the negotiation and policing of the boundary between “personal” and “professional” knowledge about social change.’

The 13 NOC counties and unitaries: runners, riders and results

In May 2010 David Cameron and Nick Clegg took just five days to form their national coalition. By contrast, starting in June 2010, the Belgians took 18 months to form theirs. English local government falls between the two.

It’s well over a month now since the national media completed their coverage of the local elections. They’d added up the seats won and lost by the various parties, calculated the national vote share they’d have received if the elections had been held in different parts of the country, and how many seats they’d have won in a 2015 General Election – but they left as unfinished business the 13 county and unitary councils they conveniently lumped together in their tables as ‘NOC’ (No Overall Control). And, though it was a short sprint by Belgian standards, it took most of that month for most of us to learn, in several of these 13 cases, the answer to that basic question the elections were supposedly about: who will actually govern?

The reasons are various: more parties, plus variegated independents, involved in negotiations; party leaders losing their own seats, or having to be re-elected or deposed at party meetings; and, above all, the fact that any inter-party agreements can only be officially implemented at pre-scheduled Annual Council Meetings, which, in some of the affected councils, only took place in the last week of May.

This blog attempts to fill in the gaps. It’s a kind of ‘runners and riders’ guide to the 13 county and unitary councils in which no single party has a majority of seats: how they got that way, and what subsequently happened.

First, the counties, in alphabetical order. CAMBRIDGESHIRE, along with Lincolnshire, Norfolk, and to a lesser extent East Sussex, was one of the previously staunchly Conservative counties that became hung largely as a result of being UKIPped. As the BBC map shows, this was a much patchier experience than was suggested by some commentators at the time – with 7 of the 27 counties still having no UKIP councillors at all and only 4, all in the south and east, having more than 10.

The Conservative leader, Nick Clarke, was one of those who lost his seat to UKIP, and the party’s remaining 32 seats left them well short of a majority. The new leader, Martin Curtis, wanted to go it alone as a minority administration, but the Independents ruled that out, while Labour and the Lib Dems refused to join UKIP in supporting an Independent-led non-Conservative rainbow coalition. Eventually, the Conservatives got half their cake: Curtis will head a minority administration for 12 months, but then UKIP’s preference, for ‘opening up’ council decision-making, kicks in and cabinets will be replaced by all-party committees.

In CUMBRIA, previously run by a Con/Lab/Independent coalition, the elections effectively reversed the standings of the Conservatives and Labour, with the latter regaining their customary position as largest party, and the slightly strengthened Lib Dems in the role of potential kingmakers. Under a new leader, Jonathan Stephenson, they opted for coalition with Labour, deputy leadership of the council, and four cabinet posts.

EAST SUSSEX is a much smaller council than Cambridgeshire, but proportionately the party arithmetic is broadly similar. Here, though, the other parties seem readier to accept a Conservative minority administration, and, as in Cambridgeshire, although a Conservative-UKIP deal could have produced a majority, none appears to have been seriously pursued.

GLOUCESTERSHIRE was a hung three-party council from 1981 to 2005, with Lib Dems generally the largest group – before, in 2009, the Conservatives suddenly took 42 of the then 63 council seats. The reduction of 10 seats, accompanying boundary changes, and the prospect of at least some recovery by Labour and possibly the Lib Dems led close observers to predict a return to NOC, and they were right. The Conservatives, though, will continue in office as a minority administration, and the Lib Dems as the main opposition party, miffed reportedly at a suspected Con-Lab deal over Scrutiny Management and other committee chairs.

Meanwhile, the county’s badgers, temporarily reprieved last autumn from the Government’s planned cull, seem to have lobbied with some effect in the elections, the new council voting by 25 to 20 with 7 abstentions to oppose the cull, now due to start later this month.

In LANCASHIRE Labour either controlled the council or were the largest party from 1981 until 2009, and were hoping to regain majority control in one go. Sensing a lifeline, the Conservatives tried talking with anyone who might be interested in forming what would presumably be an anti-Labour coalition. But the Independents didn’t want an alliance with anyone and in the end the Lib Dems agreed to support a Labour minority administration – support that will include Labour’s budget, but not necessarily much more.

LINCOLNSHIRE Conservatives are unused to coalition politics, but the party’s leadership reacted quickly to the loss of nearly half its seats by negotiating a coalition deal with the Lib Dems and Independents, before the 16 new UKIP members could even elect themselves a leader. In the week they spent doing so, the party’s regional chairman pooh-poohed on their behalf any coalition with the Conservatives, and effectively condemned them to opposition from a starting point that might have yielded rather more. The Lincolnshire Independents group were also outsmarted – three of their number breaking away to join the coalition, one with a seat in the cabinet, with rumours that others could follow them into what is still a group-with-no-name.

Across The Wash, in equally traditionally Conservative NORFOLK, the outmanoeuvred group were the Conservatives themselves. At a full council meeting, the party’s re-elected leader, Bill Borrett, apparently thought he had an agreement with the Lib Dems at least to abstain in any vote, thereby enabling him to head a minority Conservative administration. He hadn’t, and nor was he able to nail down a more explicit coalition agreement with the Lib Dems involving some key specified posts. By far the largest group thus finds itself in opposition to a minority coalition of Labour and the Lib Dems based on just 29% of council members.

UKIP’s 15 votes were needed to get this deal off the ground – plus support from the Greens and an Independent – and the UKIP group describes itself as part of the coalition. That part, though, involves no cabinet seats, but rather the achievement of a Cambridgeshire-style agreement to abolish cabinet government and return to a committee system this time next year.

Before the Conservatives swept into power in 2005, OXFORDSHIRE had been a hung council for 20 years. Labour’s comeback was limited, and, on a now a significantly smaller council, the Conservatives finished within one seat of retaining their overall majority – a position they’ve restored thanks to a CIA: a Conservative/Independent Alliance probably less alarming than it initially sounds. No cabinet seats are involved, but three Independents have agreed to work with a Conservative minority administration in the kind of ‘confidence and supply’ arrangement that many thought was as far as Cameron and Clegg would dare to go in 2010, and indeed to which they may still, before 2015, conceivably turn.

In WARWICKSHIRE Labour, though never the majority party, have regularly run the council as a minority and were hoping to regain this position. They didn’t, but they did do a deal with the Conservatives, the outcome being a Conservative minority administration, headed by the council’s first woman leader, Izzy Seccombe, with Labour holding the Scrutiny chairs, and the Lib Dems and Greens out in the cold, complaining of a stitch-up.

Now to the four hung unitaries. In BRISTOL Labour became again the largest single party and has agreed that two of its members should join Mayor George Ferguson’s all-party cabinet, which will now comprise 2 Labour members, 2 Lib Dems, I Conservative, and I Green. That may sound straightforward, but it most certainly wasn’t. Last November a similar proposal, though supported by Labour councillors, was overruled by the local party and eventually by the National Executive, and had cost the group its leader, Peter Hammond. It seems a sensible decision, but it would be surprising if that sentiment were shared universally within Labour circles.

In CORNWALL, as in Lincolnshire, some candidates continue running around long after the electoral music has stopped. Here, one of the elected Conservative members defected after 10 days to the Independents, bringing the latter group up to parity with the Lib Dems. This proved, though, less crucial than it might have, as both groups were already in discussions over some form of agreement – one possibility being an all- or multi-party rainbow alliance that could be presented to the public as a ‘Partnership for Cornwall’. What actually emerged was more mundane: an Independent/Lib Dem coalition with the more or less positive support of Labour, UKIP and Mebyon Kernow (the Party for Cornwall), the Conservatives having rejected as tokenism a scaled-back offer of two cabinet seats.

The ISLE OF WIGHT was once a Lib Dem showcase, controlled by the party either as a majority or in coalition for 16 years until 2005. It seems like history now, though, and this year’s election was largely about the exchange of seats between the Conservatives and Independents – the latter at least slightly helped by Labour and UKIP not contesting every seat that they might have done. The Island Independents, led by Ian Stephens, one of the possible beneficiaries of these arrangements, took over as easily the largest group, and will run the council as a minority administration – for the first time since 1973-77.

Having dominated the former county council, Labour will run unitary NORTHUMBERLAND for the first time as a minority administration, with the support of the three Independents – one of whom will be back as Chairman of Audit, the post she held as a Conservative councillor before resigning from the party following alleged victimisation by a senior colleague. And to think, there are some who say the local government world is boring.

Bring back committees – all is forgiven!

Governance by Committees goes back to the origins of local government in the UK. It precedes the Municipal Corporations Act of 1835 which created a legal framework whereby local government can only do what central government says it can do. It is the natural way to run an organisation. The boards of directors who run companies (or quangos) are committees. The trustees of a charity are a committee. A parliament is a committee – albeit a large and unwieldy one.

Of course not everyone on a committee is equal. The Chair has a unique position, with control of agendas, public relations, and often patronage. The secretary writes the minutes – with the subtle power to play up or play down some of what has happened. The treasurer controls the money, day to day.

Committees served local government well for at least 150 years. They were the envy of public administrators in many other parts of the world. Harold Laski promoted them, in 1935, as an extension of Athenian democracy – the advantages of a city-state running its own affairs. Forty five years later, George Jones saw them as “an essential element of a pluralist society” and a bulwark of countervailing power against an over-mighty centralising state. Thousands of councillors, over the years, learnt their trade in committees, listening to officials explaining what they wanted to do, and more experienced councillors asking questions, and having a real sense of ownership in the decisions that resulted.

Why then were committees in English local government so brusquely brushed away, to be replaced by directly elected mayors (the Labour government’s clearly preferred choice at the time) or cabinets and leaders? Why, in contrast, were they preserved, in emasculated form, in Development Control and Licensing Committees, and in councils representing populations of less than 85,000? And why are they now slowly coming back, under the liberating powers of the Localism Act, through which perhaps as many as 30 councils may have moved back to governance by committees by 2014?

By 2000 the system had, perhaps, grown out of control. The desire of councillors to be involved in every significant decision led to a proliferation of committees and subcommittees. Birmingham had more than 60. Many had delegated powers. They enabled small cliques of councillors to get things done, but many of them could not be described as open or democratic. This system also meant that cross-cutting matters (and most matters in local government are cross cutting to greater or lesser extent) went the rounds of several committees before a final decision was made – a slow and frustrating process, especially for officials. The system institutionalised silos – as each committee tenaciously defended its interests and its budgets. And it was often taken over by the party-group system, which ensured that almost all the important decisions were taken in private meetings of a political party before the official meetings in public.

It is sometimes said that committees were abolished because of Hilary Armstrong’s frustrations as a backbench member of the unwieldy and ineffective Education Committee of Durham County Council, on which she sat before becoming the MP who took the Local Government Act through the House of Commons. But it is also clear that much was wrong, that the system needed to be streamlined, and that it struggled in the new emerging world of partnerships and contracting out. F expressed in The Audit Commission summed up the frustrations in its 1990 pamphlet, We can’t go on meeting like this.

But the grass is not always greener on the other side of the hill. We can now see the limitations of mayors and cabinets. An over-concentration of power in a small number of hands, which may not be representative, or reflect the plurality of interests in something as complex as a city or county. A still confusing lack of clarity as to whether paid officials or politicians hold the real power. Weakness in standing up to bosses in London – and a creeping centralisation.

Above all, councillors are not content – especially backbench and Opposition councillors, who could make major contributions under the committee system but have almost no similar opportunities with cabinets or mayors.

And so the tide turned. The Localism Act enshrined a Conservative promise ahead of the 2010 election to give councils the chance to return to committee governance. There was no great rush – only four councils changed in 2012 (Nottinghamshire County, the London Borough of Sutton, Brighton and Hove, and South Gloucestershire). They brought in streamlined systems, with much power in the hands of Policy and Resources Committees or equivalent. These may involve little more than giving voting and speaking rights to Opposition councillors on what is still, effectively, a small cabinet or executive. But at least another 10 councils are likely to make the change at their 2013 Annual General Meetings. Others are talking about it or considering it.

INLOGOV is one of the few places that has been monitoring this change, and assisting councils to think through the issues – how to plan the detail to get the best out of a return to committees while avoiding the unsatisfactory practices that could be a problem in the past.

We have convened two workshops for councils or councillors considering making the change – and a third will take place on 27 June. Councillors and officers from councils which have changed will be present. We will not take a stand, that one system is right and the other wrong – it depends on the detail, and on local circumstances. But we will defend the right of councils to make the change, and to govern themselves as they think fit (in fact we would like to see a much wider set of systems open for consideration and experiment). If the previous workshops are anything to go by, the debate will be lively and extremely well informed.
